Terms of Service

Please read these Terms of Service ("Terms") carefully before using Spend Story ("Service"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using Spend Story, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Description of Service

Spend Story is a personal finance analysis application that processes bank statement files (PDF, Excel, CSV, TXT, OFX/QFX, QIF, MT940/SWIFT, and photos) to provide spending insights, AI-generated summaries, spending scores, and shareable content.

3. Eligibility & User Accounts

• You must be at least 18 years old (or the age of majority in your jurisdiction) to use Spend Story.
• You are responsible for maintaining the confidentiality of your account credentials.
• One account per person. You may not create multiple accounts.
• You must provide accurate and complete information.
• You are responsible for all activity under your account.

4. Acceptable Use

You agree NOT to:

• Upload fraudulent, falsified, or illegal financial documents.
• Attempt to reverse-engineer, decompile, or extract source code from the app or AI models.
• Use the Service for money laundering, fraud, or any illegal activity.
• Share your account credentials with third parties.
• Use automated tools to upload, scrape, or extract data.
• Interfere with or disrupt the Service or its infrastructure.
• Violate any applicable laws or regulations.

5. Subscription Plans & Credits

a) Free Tier

• 1 bank statement upload per month.
• Basic spending insights and categorization.

b) Pro Subscription

• Unlimited uploads, all features, priority support.
• Available as monthly or annual subscription.
• Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period.
• Pricing may change with 30 days advance notice.

c) AI Credits (In-App Purchase)

• One-time consumable purchases for AI art generation.
• Credits do not expire while your account is active.
• Credits are non-transferable between accounts.

6. Payment, Cancellation & Refunds

• All payments are processed through Apple App Store or Google Play Store.
• You may cancel your subscription at any time through your device's subscription settings (Settings > Subscriptions on iOS; Play Store > Subscriptions on Android).
• Cancellation takes effect at the end of the current billing period. You retain access until then.
• Refunds are subject to the respective store's refund policies (Apple: https://support.apple.com/billing; Google: https://support.google.com/googleplay/answer/2479637).
• We do not process payments directly and do not have access to your payment card information.

7. AI-Generated Content Disclaimer

• AI summaries, scores, insights, and categorizations are generated by artificial intelligence and are for informational and entertainment purposes only.
• Spend Story is NOT a financial advisor, accountant, or licensed professional. Our Service does NOT constitute financial, tax, investment, or legal advice.
• We do not guarantee the accuracy, completeness, or reliability of AI-generated content.
• Always verify important financial decisions with qualified professionals.
• AI art generated using credits is provided for personal, non-commercial use.

8. Intellectual Property

• The Spend Story application, brand, design, and AI models are our intellectual property.
• Shareable story cards may include the Spend Story watermark.
• Your financial data remains your property at all times.
• You grant us a limited, non-exclusive license to process your data solely for providing the Service.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind.
• We are not liable for any financial decisions made based on our insights or AI-generated content.
• We are not liable for any indirect, incidental, special, consequential, or punitive damages.
• Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
• Nothing in these Terms excludes liability for fraud, gross negligence, or any liability that cannot be excluded by law.

10. Indemnification

You agree to indemnify and hold harmless Spend Story from any claims arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

11. Termination

• We may suspend or terminate accounts that violate these Terms, with notice where practicable.
• You may delete your account at any time (Profile > Delete Account). All data will be deleted within 30 days.
• Provisions that by their nature should survive termination (liability, indemnification, intellectual property) shall survive.

12. Dispute Resolution

• We encourage you to contact us first at [email protected] to resolve any disputes informally.
• If informal resolution is not possible, disputes shall be resolved through the competent courts.
• EU residents: You may also use the EU Online Dispute Resolution platform.
• Nothing in this section limits your right to bring claims in your local courts if required by applicable consumer protection laws.

13. Governing Law

These Terms are governed by the laws of the Republic of Turkey, without regard to conflict of law provisions. This does not affect your statutory rights under the mandatory consumer protection laws of your country of residence.

14. Changes to Terms

We may update these Terms from time to time. Material changes will be notified via in-app notification at least 14 days before taking effect. Continued use after changes constitutes acceptance.

15. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall continue in full force and effect.
